The New Rhetoric is founded on the idea that since “argumentation aims at securing the adherence of those to whom it is addressed, it is, in its entirety, relative to the audience to be influenced,” says Chaïm Perelman and L. Olbrechts-Tyteca, and they rely, in particular, for their theory of argumentation on the twin concepts of universal and particular audiences: while every argument is directed to a specific individual or group, the orator decides what information and what approaches will achieve (...) the greatest adherence according to an ideal audience. This ideal, Perelman explains, can be embodied, for example, "in God, in all reasonable and competent men, in the man deliberating or in an elite.” Like particular audiences, then, the universal audience is never fixed or absolute but depends on the orator, the content and goals of the argument, and the particular audience to whom the argument is addressed. These considerations determine what information constitutes "facts" and "reasonableness" and thus help to determine the universal audience that, in turn, shapes the orator's approach. /// The adherence of an audience is also determined by the orator's use of values, a further key concept of the New Rhetoric. Perelman's treatment of value and his view of epideictic rhetoric sets his approach apart from that of the ancients and of Aristotle in particular. Aristotle's division of rhetoric into three genres–forensic, deliberative, and epideictic–is largely motivated by the judgments required for each: forensic or legal arguments require verdicts on past action, deliberative or political rhetoric seeks judgment on future action, and epideictic or ceremonial rhetoric concerns values associated with praise or blame and seeks no specific decisions. For Aristotle, the epideictic genre was of limited importance in the civic realm since it did not concern facts or policies. Perelman, in contrast, believes not only that epideictic rhetoric warrants more attention, but that the values normally limited to that genre are in fact central to all argumentation. "Epideictic oratory," Perelman argues, "has significant and important argumentation for strengthening the disposition toward action by increasing adherence to the values it lauds.” These values are central to the persuasiveness of arguments in all rhetorical genres since the orator always attempts to "establish a sense of communion centered around particular values recognized by the audience.”. The operation of developing a concept is a common procedure in mathematics and in natural science, but has traditionally seemed much less possible to philosophers and, especially, logicians. Meir Buzaglo's innovative study proposes a way of expanding logic to include the stretching of concepts, while modifying the principles which block this possibility. The philosophy of Solomon Maimon is usually considered an important link between Kant’s transcendental philosophy and German idealism. Highly praised during his lifetime, over the past two centuries Maimon’s genius has been poorly understood and often ignored. Meir Buzaglo offers a reconstruction of Maimon’s philosophy, revealing that its true nature becomes apparent only when viewed in light of his philosophy of mathematics. This provides the key to understanding Maimon’s solution to Kant’s _quid juris_ question concerning the connection between intuition (...) and concept in mathematics. Maimon’s original approach avoids dispensing with intuition while reducing the reliance on intuition in its Kantian sense. As Buzaglo demonstrates, this led Maimon to question Kant’s ultimate rejection of the possibility of metaphysics and, simultaneously, to suggest a unique type of skepticism. (shrink)

In this paper we prove that from large cardinals it is consistent that there is a singular strong limit cardinal $\nu $ such that the singular cardinal hypothesis fails at $\nu $ and every collection of fewer than $\operatorname {\mathrm {cf}}(\nu )$ stationary subsets of $\nu ^{+}$ reflects simultaneously. For $\operatorname {\mathrm {cf}}(\nu )> \omega $, this situation was not previously known to be consistent. Using different methods, we reduce the upper bound on the consistency strength of this situation for (...) $\operatorname {\mathrm {cf}}(\nu ) = \omega $ to below a single partially supercompact cardinal. This book discusses the justifications and limits of cultural nationalism from a liberal perspective. Chaim Gans presents a normative typology of nationalist ideologies, distinguishing between cultural liberal nationalism and statist liberal nationalism. Statist nationalisms argue that states have an interest in the cultural homogeneity of their citizenries. Cultural nationalisms argue that people have interests in adhering to their cultures and in sustaining these cultures for generations. Gans argues that freedom- and identity-based justifications for cultural nationalism common in literature can (...) only support the adherence thesis, while the historical thesis could only be justified by the interest people have in the long-term endurance of their personal and group endeavors. The Limits of Nationalism examines demands often made in the name of cultural nationalism, such as claims for national self-determination, historical rights claims to territories and demands entailed by cultural particularism as opposed to cultural cosmopolitanism. This article examines the grappling of modern positivists with the question of legal unity. It presents and contrasts two antagonistic positivist strands—naturalist and normativist—epitomized in the works of Austin and Kelsen, respectively. The two strands correspond to two contrasting models of legal authority—criterial and coherence-based—and they accordingly diverge on the proper explanation of unity. Naturalist, criterial models purport to explain the unity of law based on extra-legal facts alone; normativist, coherence-based models resort strictly to the interrelation of legal elements themselves. Against this backdrop, the article argues that Raz’s work on the subject is torn between Austin and Kelsen: While his naturalist ancestors accounted for legal unity externally, Raz’s prominent works are captivated by the Kelsenian realization that the unity of law must be accounted for internally. Two central upshots follow. First, the analysis provides a litmus test for the (in)ability of naturalist positivism to explain legal unity. Second, Raz’s strategic reliance on Kelsen distorts his work: Both the Grundnorm and validity chains are upended to fit Raz’s naturalist commitments. (shrink)

Metaphor abounds in both sign and spoken languages. However, in sign languages, languages in the visual-manual modality, metaphors work a bit differently than they do in spoken languages. In this paper we explore some of the ways in which metaphors in sign languages differ from metaphors in spoken languages. We address three differences: (a) Some metaphors are very common in spoken languages yet are infelicitous in sign languages; (b) Body-part terms are possible in very specific types of metaphors in sign (...) languages, but are not so restricted in spoken languages; (c) Similes in some sign languages are dispreferred in predicative positions in which metaphors are fine, in contrast to spoken languages where both can appear in these environments. We argue that these differences can be explained by two seemingly unrelated principles: the Double Mapping Constraint (Meir 2010), which accounts for the interaction between metaphor and iconicity in languages, and Croft's (2003) constraint regarding the autonomy and dependency of elements in metaphorical constructions. We further argue that the study of metaphor in the signed modality offers novel insights concerning the nature of metaphor in general, and the role of figurative speech in language. (shrink)

We investigate the interaction between compactness principles and guessing principles in the Radin forcing extensions. In particular, we show that in any Radin forcing extension with respect to a measure sequence on [Formula: see text], if [Formula: see text] is weakly compact, then [Formula: see text] holds. This provides contrast with a well-known theorem of Woodin, who showed that in a certain Radin extension over a suitably prepared ground model relative to the existence of large cardinals, the diamond principle fails (...) at a strongly inaccessible Mahlo cardinal. Refining the analysis of the Radin extensions, we consistently demonstrate a scenario where a compactness principle, stronger than the diagonal stationary reflection principle, holds yet the diamond principle fails at a strongly inaccessible cardinal, improving a result from [O. According to influential views the probabilities in classical statistical mechanics and other special sciences are objective chances, although the underlying mechanical theory is deterministic, since the deterministic low level is inadmissible or unavailable from the high level. Here two intuitions pull in opposite directions: One intuition is that if the world is deterministic, probability can only express subjective ignorance. The other intuition is that probability of high-level phenomena, especially thermodynamic ones, is dictated by the state of affairs in the world. (...) We argue in support of this second intuition and we show that in fact there are two different ways in which high-level probability describes matters of fact, even if the underlying microscopic reality is deterministic. Our analysis is novel, but supports approaches by, e.g., Loewer, Albert, Frigg and Hoefer, List and Pivato. In particular, the reductive view we propose here can be seen as a naturalization of the above approaches. We consider consequences of our result for nonreductive physicalist approaches, such as functionalism, that admit multiple realization of the kinds that appear in the special sciences by physical kinds. We show that nonreductive physicalism implies the existence of nonphysical matters of fact. (shrink)

This paper describes a version of type identity physicalism, which we call Flat Physicalism, and shows how it meets several objections often raised against identity theories. This identity theory is informed by recent results in the conceptual foundations of physics, and in particular clar- ifies the notion of ‘physical kinds’ in light of a conceptual analysis of the paradigmatic case of reducing thermody- namics to statistical mechanics. We show how Flat Physi- calism is compatible with the appearance of multiple realisation (...) in the special sciences, and how and in what sense the special sciences laws are autonomous from the laws of physics, despite the full reductive picture of Flat Physicalism. We compare our view with a recent proposal by William Bechtel that accounts for the appearance of levels in mechanistic explanations. (shrink)

We argue that certain types of many minds (and many worlds) interpretations of quantum mechanics, e.g. Lockwood ([1996a]), Deutsch ([1985]) do not provide a coherent interpretation of the quantum mechanical probabilistic algorithm. By contrast, in Albert and Loewer's ([1988]) version of the many minds interpretation, there is a coherent interpretation of the quantum mechanical probabilities. We consider Albert and Loewer's probability interpretation in the context of Bell-type and GHZ-type states and argue that it implies a certain (weak) form of nonlocality. We show that the so-called Multiple-Computations Theorem in cognitive science and philosophy of mind challenges Landauer’s Principle in physics. Since the orthodox wisdom in statistical physics is that Landauer’s Principle is implied by, or is the mechanical equivalent of, the Second Law of thermodynamics, our argument shows that the Multiple-Computations Theorem challenges the universal validity of the Second Law of thermodynamics itself. We construct two examples of computations carried out by one and the same dynamical process with respect to which (...) Landauer’s principle implies contradictory predictions concerning the entropy increase. Our two examples are based on a weak version of the Multiple-Computations Theorem, which is quite uncontroversial, and therefore they amount to a clear refutation of the universal validity of Landauer’s Principle. We consider some responses to this argument that do not attempt to single out one computation over the others, and we show that they do not work. We further consider ways out of the argument by externalist approaches supporting the computational theory of the mind who propose that the interaction of a computing system with the environment is enough to select a single computation over the others. We show on physical grounds that this approach fails too. We then reverse the direction of our challenge and formulate a dilemma for supporters of the computational theory of the mind: they must reject the causal closure of physic; or else they must accept on a priori grounds that Landauer’s Principle and the Second Law of thermodynamics are not universally valid. Finally, we present our version of a type–type mind-brain identity theory called Flat Physicalism, which is based on the paradigm case of statistical mechanics, and we show that it circumvents the challenge from Landauer’s Principle and the Multiple-Computations Theorem and does not fall prey to our dilemma. Can we explain the laws of thermodynamics, in particular the irreversible increase of entropy, from the underlying quantum mechanical dynamics? Attempts based on classical dynamics have all failed. Albert (1994a,b; 2000) proposed a way to recover thermodynamics on a purely dynamical basis, using the quantum theory of the collapse of the wavefunction of Ghirardi, Rimini and Weber (1986). In this paper we propose an alternative way to explain thermodynamics within no-collapse interpretations of quantum mechanics. Our approach relies on the standard (...) quantum mechanical models of environmental decoherence of open systems, e.g. Joos and Zeh (1985) and Zurek and Paz (1994). (shrink)

This paper makes a novel linkage between the multiple-computations theorem in philosophy of mind and Landauer’s principle in physics. The multiple-computations theorem implies that certain physical systems implement simultaneously more than one computation. Landauer’s principle implies that the physical implementation of “logically irreversible” functions is accompanied by minimal entropy increase. We show that the multiple-computations theorem is incompatible with, or at least challenges, the universal validity of Landauer’s principle. To this end we provide accounts of both ideas in terms of (...) low-level fundamental concepts in statistical mechanics, thus providing a deeper understanding of these ideas than their standard formulations given in the high-level terms of thermodynamics and cognitive science. Since Landauer’s principle is pivotal in the attempts to derive the universal validity of the second law of thermodynamics in statistical mechanics, our result entails that the multiple-computations theorem has crucial implications with respect to the second law. Finally, our analysis contributes to the understanding of notions, such as “logical irreversibility,” “entropy increase,” “implementing a computation,” in terms of fundamental physics, and to resolving open questions in the literature of both fields, such as: what could it possibly mean that a certain physical process implements a certain computation. The paper presents a simple game-theoretic model in which players decide on search procedures for a prize located in one of a set of labeled boxes. The prize is awarded to the player who finds it first. A player can decide on the number of (costly) search units he employs and on the order in which he conducts the search. It is shown that in equilibrium, the players employ an equal number of search units and conduct a completely random search. (...)
